Medical Malpractice Insurance Claims Examples
The following are real examples of claims received by QBE customers that illustrate some of the most common claim scenarios for which a medical malpractice policy is required.

Claim against rehabilitation centre
The Insured operated a rehabilitation centre and inpatient centre for sub-acute cases. The Claimant was admitted to the Insured by their general practitioner due to continued pain and unexplained fever. While an inpatient the Claimant complained of numbness in the legs on three separate occasions. The Insured's nursing employees did not notify the treating doctor of this development. The Claimant was transferred to hospital and investigations subsequently revealed an epidural abscess. The Claimant now suffers from incomplete paraplegia.

Result: Claim reserved for more than $500,000

Claim against chiropractor
The Claimant consulted the Insured for chiropractic treatment after a fall. The Claimant alleged that on the first attendance treatment by the Insured caused a fracture of the pelvis and that the treatment caused lumbar disc and joint damage.

Result: Claim settled for approx. $225,000 with a further $81,000 incurred in legal defence costs

Claim against natural therapist
The Insured was a natural therapist who treated the Claimant with massage and myofascial stretching. At a consultation the Insured performed massage and stretches of the patient's lumbar, thoracic and neck areas, following which the Claimant suffered a stroke.

Result: Claim settled for more than $400,000 with approx. $25,000 in legal defence costs incurred

Claim against health service/clinic
The Claimant attended the Insured's medical clinic and it is alleged that a brain tumour was not detected or treated despite several consultations complaining of relevant symptoms (including headaches, migraines, nausea and vomiting).

Result: Claim reserved for more than $1,000,000

Claim against nutritionist
The Claimant alleged that the Insured failed to properly diagnose a metabolic condition, resulting in them suffering personal and psychological injury.

Result: Claim settled with more than $80,000 incurred in legal costs

Claim against aged care facility
The claimant suffered a number of falls resulting in significant injury while in the Insured's care.

Result: Claim settled for more than $800,000 with an additional $240,000 incurred in legal defence and other costs

Claim against pathology service
The Insured provided pathology services including diagnostic services where testing and reporting on samples was provided.

The Claimant commenced proceedings in the District Court alleging false diagnosis of a malignant invasive duct carcinoma from breast tissue samples. The diagnosis resulted in unnecessary surgery to remove tissue and lymph nodes which allegedly causing the plaintiff shock, anxiety, depression, psychological injury resulting in continued depression, anxiety, post traumatic stress disorder, scarring and under arm difficulties, and altered interpersonal relationships and work duties.

Result: $25,000 incurred to date

Claim against medical clinic
The Insured ran a chain of medical clinics. It is alleged that the Insured failed to contact the patient as instructed by the treating doctor resulting in a delayed diagnosis of lung cancer which, if detected earlier, could potentially have been treated more effectively.

Result: $145,000 incurred to date with approximately $30,000 incurred in legal defence costs
